{"id":46792,"date":"2026-05-20T09:06:24","date_gmt":"2026-05-20T07:06:24","guid":{"rendered":"https:\/\/gamn.org\/?p=46792"},"modified":"2026-06-12T09:07:56","modified_gmt":"2026-06-12T07:07:56","slug":"njezet-vjet-reforma-pa-rritje-te-dukshme-te-besimit-ne-sistem-gjyqesor","status":"publish","type":"post","link":"https:\/\/gamn.org\/sq\/njezet-vjet-reforma-pa-rritje-te-dukshme-te-besimit-ne-sistem-gjyqesor\/","title":{"rendered":"Nj\u00ebzet vjet reforma pa rritje t\u00eb dukshme t\u00eb besimit n\u00eb sistem gjyq\u00ebsor"},"content":{"rendered":"<p>Nj\u00ebzet vjet pas rivendosjes s\u00eb pavar\u00ebsis\u00eb, Mali i Zi ende nuk ka nj\u00eb sistem gjyq\u00ebsor q\u00eb qytetar\u00ebt e perceptojn\u00eb si mjaftuesh\u00ebm t\u00eb pavarur, efikas dhe rezistent ndaj ndikimeve politike ky \u00ebsht\u00eb p\u00ebrfundimi kryesor i publikimit \u201cDy dekada reformash n\u00eb sistemin gjyq\u00ebsor e Malit t\u00eb Zi\u201d, t\u00eb cilin Aleanca Qytetare e p\u00ebrgatiti me rastin e Dit\u00ebs s\u00eb Pavar\u00ebsis\u00eb.<\/p>\n<p>Publikimi jep nj\u00eb pasqyr\u00eb t\u00eb zhvillimit t\u00eb gjyq\u00ebsorit nga viti 2006 e deri m\u00eb sot p\u00ebrmes proceseve reformuese n\u00eb kuad\u00ebr t\u00eb integrimeve evropiane, raporteve t\u00eb Komisionit Evropian, treguesve statistikor\u00eb t\u00eb pun\u00ebs s\u00eb gjykatave dhe prokuroris\u00eb shtet\u00ebrore, si dhe hulumtimeve t\u00eb opinionit publik mbi besimin e qytetar\u00ebve n\u00eb institucione.<\/p>\n<p>Megjith\u00ebse gjat\u00eb dy dekadave t\u00eb fundit jan\u00eb miratuar ligje t\u00eb reja, \u00ebsht\u00eb ndryshuar kuadri institucional dhe jan\u00eb zbatuar reforma t\u00eb shumta n\u00eb fush\u00ebn e sundimit t\u00eb ligjit, gjetjet tregojn\u00eb se p\u00ebrparimet e pritura nuk jan\u00eb b\u00ebr\u00eb mjaftuesh\u00ebm t\u00eb dukshme n\u00eb funksionimin e p\u00ebrditsh\u00ebm t\u00eb sistemit. Qytetar\u00ebt dhe qytetaret vazhdojn\u00eb t\u00eb identifikojn\u00eb si probleme kryesore ndikimin politik, korrupsionin, procedurat e gjata dhe rezultatet e kufizuara n\u00eb luft\u00ebn kund\u00ebr krimit t\u00eb organizuar dhe korrupsionit t\u00eb nivelit t\u00eb lart\u00eb.<\/p>\n<p>Sipas t\u00eb dh\u00ebnave t\u00eb hulumtimit t\u00eb paraqitur n\u00eb publikim, 35,2% e qytetar\u00ebve konsiderojn\u00eb se gjendja n\u00eb gjyq\u00ebsor q\u00eb nga rivendosja e pavar\u00ebsis\u00eb \u2018nuk ka ndryshuar ndjesh\u00ebm\u2019, nd\u00ebrsa vet\u00ebm 8,4% vler\u00ebsojn\u00eb se gjyq\u00ebsori \u2018ka p\u00ebrparuar ndjesh\u00ebm\u2019. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, m\u00eb shum\u00eb se gjysma e t\u00eb anketuarve, 51,7%, e vler\u00ebsojn\u00eb negativisht pun\u00ebn e gjyq\u00ebsorit gjat\u00eb vitit t\u00eb fundit.<\/p>\n<p>Vler\u00ebsimet negative jan\u00eb ve\u00e7an\u00ebrisht t\u00eb theksuara kur b\u00ebhet fjal\u00eb p\u00ebr rezistenc\u00ebn e sistemit ndaj ndikimeve politike, t\u00eb cil\u00ebn negativisht e vler\u00ebsojn\u00eb 64,1% e t\u00eb anketuarve, si dhe p\u00ebr efikasitetin e pun\u00ebs dhe koh\u00ebzgjatjen e procedurave gjyq\u00ebsore, ku q\u00ebndrim negativ kan\u00eb 65,4% e qytetar\u00ebve. Hulumtimi nj\u00ebkoh\u00ebsisht tregon se qytetar\u00ebt dhe qytetaret e vler\u00ebsojn\u00eb m\u00eb pozitivisht profesionalizmin e gjyqtar\u00ebve dhe prokuror\u00ebve sesa m\u00ebnyr\u00ebn e funksionimit t\u00eb sistemit n\u00eb t\u00ebr\u00ebsi, gj\u00eb q\u00eb tregon se problemet kryesisht identifikohen n\u00eb organizimin institucional dhe menaxhimin.<\/p>\n<p>Qytetar\u00ebt dhe qytetaret japin gjithashtu nj\u00eb nivel t\u00eb lart\u00eb mb\u00ebshtetjeje p\u00ebr zbatimin e verifikimit t\u00eb p\u00ebrgjegj\u00ebsis\u00eb profesionale (vettingut) n\u00eb gjyq\u00ebsor dhe n\u00eb Drejtorin\u00eb e Policis\u00eb. K\u00ebt\u00eb mas\u00eb e mb\u00ebshtesin m\u00eb shum\u00eb se 77% e t\u00eb anketuarve, nd\u00ebrsa vet\u00ebm 6,5% jan\u00eb kund\u00ebr saj.<\/p>\n<p>Publikimi rikujton gjithashtu se raportet e Komisionit Evropian prej vitesh theksojn\u00eb t\u00eb nj\u00ebjtat probleme \u2013 ndikimin politik n\u00eb gjyq\u00ebsor, procedurat e gjata, numrin e madh t\u00eb l\u00ebnd\u00ebve t\u00eb pazgjidhura dhe rezultatet e pamjaftueshme n\u00eb ndjekjen penale t\u00eb krimit t\u00eb organizuar dhe korrupsionit. T\u00eb dh\u00ebnat statistikore mbi pun\u00ebn e gjykatave dhe prokurorive e konfirmojn\u00eb m\u00eb tej ngarkes\u00ebn shum\u00ebvje\u00e7are t\u00eb sistemit, ve\u00e7an\u00ebrisht n\u00eb rastet komplekse.<\/p>\n<p>Nj\u00eb sfid\u00eb e ve\u00e7ant\u00eb paraqet edhe puna e prokuroris\u00eb shtet\u00ebrore, e cila p\u00ebrballet me munges\u00eb t\u00eb stafit, kapacitete t\u00eb pap\u00ebrshtatshme hap\u00ebsinore, pajisje teknike t\u00eb pamjaftueshme dhe rritje t\u00eb kompleksitetit t\u00eb l\u00ebnd\u00ebve, ve\u00e7an\u00ebrisht n\u00eb fushat q\u00eb k\u00ebrkojn\u00eb njohuri t\u00eb specializuara nga ekonomia, financat dhe teknologjit\u00eb informative.<\/p>\n<p>Nj\u00ebzet vjet reforma kan\u00eb treguar se miratimi i ligjeve dhe ndryshimet institucionale nuk jan\u00eb t\u00eb mjaftueshme pa zbatimin e tyre t\u00eb q\u00ebndruesh\u00ebm n\u00eb praktik\u00eb.
